You will have a period of 14 days, starting from the date of receipt of the order, to inform KIT CAT of your intention to exercise this right. You must send an email to info@kitcat.es indicating the reason for withdrawal, the full name used to place the order and the order number.

Once you inform us of your intention to exercise this right, we will provide you with an address to which you must send the products in question, without undue delay and, in any case, no later than 14 calendar days from the date on which you notify us of your decision to withdraw.

The products must be returned in their original condition, without signs of improper use, damage or manipulation, and with all accessories (including hangers), original packaging and original labels.

Once we receive the products at our facilities and verify that they are in perfect condition, we will proceed to refund all payments received, including standard delivery costs. If you selected a shipping method other than the standard method, you will be responsible for paying the difference.

If the products do not arrive in optimal condition due to actions attributable to the customer, KIT CAT reserves the right not to accept the withdrawal or to refund a reduced amount for the order, taking into account the depreciation in the value of the product. In this regard, by way of illustration but not limitation, KIT CAT will consider the following circumstances:

• Packaging or wrapping that does not correspond to the original.
• Noticeable use and/or wear of the product.
• Stains, scratches, damage or unpleasant odours on the products.

Important: the direct costs of returning the products will be borne by the customer.

Exceptions to the right of withdrawal

The right of withdrawal will not apply in the following cases:

• Personalised products.
• Products that may deteriorate or expire quickly.
• Sealed products that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.

The description of each product will provide detailed information indicating whether the product is excluded from the right of withdrawal.

You must notify us of any defects in the product by email at info@kitcat.es within 24 hours of receiving the order. KIT CAT may contact you to request additional information or evidence that clearly and demonstrably proves the existence of the reported defects in the product.

You must then send the product in question to the address provided by us, in its original packaging, including all accessories and documentation that accompanied the product at the time of delivery.

Once we receive the product, you may choose between receiving a refund of the amount paid for the defective product or having the product replaced with one in perfect condition or repaired. KIT CAT reserves the right to choose between repairing or replacing the defective product, depending on which option is most appropriate and feasible. The choice will depend on the nature of the defect and the availability of similar products. If repairing or replacing the defective product is not possible, we undertake to provide a full refund, including the shipping costs associated with the defective product.

For defective products: the direct return costs will be borne by KIT CAT.

2 years

For all products purchased before 1 January 2022, from the date of delivery.

3 years

For all products purchased after 1 January 2022, from the date of delivery.

Products will be considered compliant with the contract if:

1. They meet the requirements set out in the applicable regulations.
2. They conform to the description, type of goods, quantity and quality, and possess the functionality and other characteristics established in the contract.
3. They are suitable for the specific purposes for which you need them.
4. They conform to the seller's description, the qualities presented to the customer, suitability for ordinary use and the usual characteristics of similar products.

The warranty will cover the repair of the product or its replacement with a new one. If neither of these options is possible, a reduction in the price of the product or termination of the contract entered into will be considered.

The warranty does not cover damage caused by negligence, impacts, improper use or handling, unsuitable voltage, electrical accidents, installation and/or use that does not comply with the instructions for use or that has not been carried out by the authorised technical service where applicable, nor does it cover materials or perishable products, products subject to wear and tear through normal use or consumable products.

Likewise, KIT CAT shall not be liable for any lack of conformity that the customer knew about or could not reasonably have been unaware of at the time the contract was entered into.

KIT CAT shall not be liable for:

• Losses that are not attributable to any breach by KIT CAT.
• Business losses, including loss of profits, revenue, contracts, anticipated savings, data, goodwill or unnecessarily incurred expenses.
• Any indirect or consequential losses that were not reasonably foreseeable by the parties at the time the contract for the sale of the goods or products was entered into between them.
• Any delay or failure to fulfil its obligations under these terms and conditions where such delay or failure results from circumstances beyond KIT CAT's reasonable control or is attributable to any third party.

This provision does not affect your right to receive the product within a reasonable period in accordance with Spanish law.
